“What Keeps You Up at Night?” Survey Submission Terms

Thank you for participating in this voluntary survey conducted by Resy Network, Inc. (“Resy”). By submitting your responses, you acknowledge and agree to the following terms:

1. Voluntary Participation

Participation in this survey is voluntary. You are not required to submit a response, and choosing not to participate will not affect your relationship with Resy.

2. Use of Survey Responses

By submitting your responses, you grant Resy a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, publish, display, distribute, adapt, edit, and otherwise use your responses, in whole or in part, in connection with Resy’s editorial content and business purposes.

Survey responses may be used in Resy’s new editorial series, “What Keeps You Up at Night?”, including publication on Resy’s blog or other Resy-owned channels. Selected responses may also be shared with members of the American Express Global Dining Advisory Board for purposes of gathering commentary or feedback, which may be included alongside the responses in editorial content.

3. Attribution and Publicity Consent

You agree that Resy may identify you and/or your restaurant in connection with your submission, including by using your name, restaurant name, business affiliation, city/location, and any statements or quotations from your responses, in connection with the editorial series or related promotional materials.

You grant Resy permission to use such identifying information for editorial and promotional purposes without further notice, approval, or compensation.

4. Editorial Discretion

Resy retains sole editorial discretion over whether and how survey responses are used. Resy may edit responses for clarity, length, formatting, or style, and Resy is under no obligation to publish any submission.

5. Representations and Warranties

By submitting a response, you represent and warrant that:

You are authorized to provide the response on behalf of yourself and/or the restaurant or business identified.
Your submission is truthful and reflects your own opinions or experiences.
Your submission does not include confidential, proprietary, or sensitive information that you are not authorized to disclose.
Your submission does not violate the rights of any third party, including intellectual property, privacy, or confidentiality rights, and does not contain defamatory statements.

6. Public Nature of Submissions

Please do not include confidential, proprietary, or sensitive business information in your responses. Responses may be publicly published or quoted as part of Resy editorial content.

7. Opinions and Informational Content

Any views expressed in survey responses reflect the views of the individual submitter. Feedback provided by members of the American Express Global Dining Advisory Board represents their individual perspectives and is provided for informational purposes only. Such content does not constitute professional, financial, operational, or legal advice.

8. Right to Anonymize

Resy may publish responses with or without attribution and may anonymize or aggregate responses.

9. No Endorsement

Inclusion of a restaurant or individual in the editorial series does not constitute endorsement by Resy or American Express.

10. Privacy

Personal information collected through this survey will be processed in accordance with the Resy Privacy Policy, available here: https://resy.com/privacy.

11. Limitation of Liability

To the fullest extent permitted by law, Resy shall not be liable for any indirect, incidental, consequential, or business-related damages arising from or related to the publication or use of survey responses or related editorial content.
